1. What is the purpose of the terms of use?
The trust you place in us every day is our priority. Therefore, we do everything we can to ensure that you can maintain this trust on a daily basis, which obviously involves adhering to and being aware of the terms of use ("TOU").
The TOU, which apply to all our services, aim to present the rules you must follow when using our website, knowing that any use of the site implies unconditional acceptance of the TOU.
You confirm that you have read the TOU prior to any use of our site and have all the necessary information and skills to ensure that the services provided meet your needs.
2. What are our commitments regarding the Site?
We provide you with the Site intended to give you all the information you might be looking for about our service offerings and our company.
We do our utmost to offer you a quality website, accessible 24/7, that provides accurate and precise content, free from any risk of technical failure.
However, since "zero risk" does not exist in IT, our liability cannot be engaged in case of harm that may arise from the use of the website because we cannot be responsible for any potential errors, unavailability, or interruptions that may occur on our website or if a virus is accessible from our website. We are also not responsible for delays or your inability to meet your obligations under the TOU if the delay or impossibility results from a cause beyond our reasonable control.
Additionally, your access to our website and services may occasionally be suspended or limited to allow for repairs, maintenance, or to add new functionality or a new service.
3. What are the applicable rules regarding intellectual property?
We are and remain the exclusive holders of all intellectual property rights on brands (e.g., Episto, Jering, etc.), graphic designs or logos, or any other element you may see when using our Site.
We are and remain also the exclusive holders of all intellectual property rights and licenses of third-party editors applicable to the overall structure of the Site, such as the software used to operate it, the algorithms we have developed, the APIs we use, the content of the Site that we write and/or choose (e.g., text, sound, drawings, Privacy Policy, Cookies Policy, etc.), our know-how, etc.
The fact that you can access it freely during your use does not imply that we grant you any license or right to use the elements of this Site.
You therefore do not have the right to use these elements, in any way, in whole or in part, without our prior written consent. Any use on your part that we have not authorized may constitute a violation subject to the provisions of Articles L335-2 and following of the Intellectual Property Code and Articles L713-2 and following of the same code.
Our Site may also mention, for various reasons, other logos, trademarks, or registered trademarks belonging to us or to third parties and protected by industrial property rights. As such, any unauthorized use of these elements constitutes infringement.
4. How do we use your personal data?
When we work together and you navigate our Site, we have no choice but to process your personal data, particularly to handle your requests, manage our business relationships, etc.
To facilitate your understanding of how we process your data, we have drafted a Privacy Policy, accessible at any time on our Site, which aims to present the reasons and the manner in which we process your data as part of the services we provide.
We may also be required to use “Cookies,” particularly to operate the Site. You can obtain more precise information about how we use “Cookies” on your devices (e.g., mobile phone, computer, tablet, etc.) at any time through our “Cookies” Policy, also accessible at any time on our Site.
5. What is the applicable “standard” language?
The Site may be translated into different languages. However, French remains the “standard” language of our company and our operations. The French language therefore always prevails over the other versions of the Site in the context of our working relationship, particularly in the case of misinterpretation, dispute, litigation, or difficulty of interpretation regarding our services.
6. What are the rules regarding hyperlinks?
The Site may contain hyperlinks to websites or third-party Sites. You are informed that we are neither responsible nor liable for the offers, acts, content, products, services, or any other element available through these links.
Furthermore, we thank you in advance for notifying us of any hyperlink present on the Site that would allow access to a third-party Site offering content contrary to laws or good morals.
7. Nullity
The nullity of any clause herein does not result in the nullity of the Terms of Use, and the other clauses will continue to have effect.
8. Waiver
The fact that Jering does not temporarily or permanently invoke one or several clauses of the Terms of Use will not in any case be considered a waiver of invoking them.
9. What is the governing law for the use of the Site or any dispute regarding these terms and conditions?
Jering is a company under French law. Consequently, the use of our website is subject to French law and any disputes will be brought exclusively before the competent French courts.
10. Can the terms and conditions be modified?
We reserve the right to modify the Terms of Use at any time and without notice. We therefore advise you to consult them as regularly as possible.
